§ 1 Scope and Subject Matter
(1) These Terms of Use govern the use of the app "kieldawnpatrol.cc" (hereinafter "App"), operated by Kiel Dawn Patrol e. V. (a registered association under German law, eingetragener Verein), c/o Velostyle, Grasweg 8, 24118 Kiel (hereinafter "Verein").
(2) The App serves as a community platform for the organisation and management of group cycling rides. It serves the Verein in particular as a tool for maintaining participant lists for insurance purposes. Users can register for rides via the App, view their personal ride statistics, and connect with other users.
(3) Use of the App is free of charge. No membership fees or charges arise from registration or use of the App.
(4) Use of the App does not constitute membership in the Verein. The App is open to both Verein members and guest riders alike.

§ 2 Registration and Account
(1) Registration is required to use the App. A first and last name as well as a valid email address are required for registration.
(2) Registration is open to persons aged 16 years or older. By registering, the user confirms that they have reached the age of 16.
(3) Each user may only create one account. Sharing login credentials with third parties is prohibited.
(4) The user may delete their account at any time via the App settings. The consequences of deletion are set out in § 10 and in the Privacy Policy.

§ 3 Roles and Permissions
The App features the following roles:
(1) User (default role): May register for rides, view their own ride statistics, use the friend feature, and optionally upload a profile picture. The profile picture is only visible to connected friends.
(2) Guide: May additionally view the participant list for rides to which they have been assigned as Guide. The identity of the Guide is visible to all participants of the respective ride. The Guide's profile picture is visible to all registered participants of the respective ride. Guides sign a confidentiality agreement (Vertraulichkeitserklärung) before being granted their role.
(3) Administrator: Has access to all user data and participant lists for the purpose of managing the Verein's activities. The profile picture is subject to the same extended visibility as for Guides. Administrators also sign a confidentiality agreement (Vertraulichkeitserklärung).

§ 4 Klarnamenpflicht (Real Name Requirement) and Accurate Information
(1) Use of the App requires the provision of the user's correct legal first and last name. The use of pseudonyms, stage names, fictional names, or the names of other persons is not permitted.
(2) The Klarnamenpflicht is necessary to ensure the unambiguous identification of participants in the event of an insurance claim. Without correct name details, insurance coverage through the Verein cannot be guaranteed.
(3) The Verein reserves the right to suspend or delete user accounts with obviously false name details without prior notice.
(4) Guides may carry out identity checks before the start of a ride (e.g. by comparing details against a photo ID). Refusal to submit to an identity check may result in exclusion from the ride.

§ 5 Friend Feature
(1) The App offers the ability to connect with other users ("friendship"). A connection is only established upon mutual confirmation.
(2) Connected users can see whether their respective friend has registered for a ride.
(3) Ride participation is by default only visible to Administrators and Guides. Visibility to other users only arises through a confirmed friend connection.
(4) Either party may dissolve a connection at any time. Upon dissolution, mutual visibility ceases immediately.

§ 6 Participation in Rides
(1) Registering for a ride via the App constitutes a binding commitment to participate. Cancellation is possible up until the start of the ride.
(2) If a registered participant fails to appear for a ride without having cancelled beforehand, their participation data (name and date of the ride) will nevertheless be retained for the 3-year period specified in § 10(3), as it is not always possible to verify actual attendance after the fact.
(3) Participation in rides requires prior registration via the App. Persons who participate in a ride without having registered do so at their own risk and without insurance coverage through the Verein. The Verein is not obliged to verify the registration of all participants on site.
(4) Participation in rides is at the participant's own risk and responsibility. The App serves solely for organisational purposes; the Verein assumes no responsibility for the execution of rides beyond the insurance coverage provided.
(5) All participants commit to strictly complying with the applicable rules of the Straßenverkehrsordnung (StVO) (German Road Traffic Regulations) throughout the entire ride. Guides do not assume any traffic safety obligations (Verkehrssicherungspflicht).
(6) Changes to the route, schedule, or timing of a ride (e.g. due to weather, road closures, or other circumstances) are reserved. In the event of a ride cancellation, registered participants will, where possible, be notified via push notification, provided they have enabled this feature. No entitlement to timely notification exists.
(7) By registering for a ride, participants confirm the Participation and Risk Notice (Teilnahme- und Risikohinweis) of the Verein.

§ 7 Equipment, Fitness and Safety
(1) By registering for a ride, participants confirm that they are physically capable of participating in the respective ride and that they are not aware of any health conditions that would preclude their participation. The assessment of one's own physical fitness is the participant's own responsibility; the Verein assumes no responsibility in this regard.
(2) Each participant is responsible for ensuring the technically sound and road-safe condition of their bicycle. This includes, in particular, functioning lights, brakes, and tyres.
(3) The Verein strongly recommends wearing an appropriate cycling helmet on all rides. The decision to wear a helmet is the participant's own responsibility. The Verein points out that failure to wear a helmet may be considered contributory negligence (Mitverschulden) in the event of an accident.
(4) For your safety, we recommend setting up the SOS emergency function on your smartphone (iOS: Emergency SOS / Medical ID; Android: Safety & Emergency). Emergency contacts are intentionally not stored in the App.

§ 8 Insurance Coverage
(1) Participants in rides organised by the Verein are covered under the Verein's insurance policy (Vereinsversicherung). This applies to both Verein members and guest riders.
(2) Insurance coverage requires the correct provision of the participant's legal name (see § 4) and proper registration via the App.
(3) Participants who have not registered via the App or who have provided false personal details may be excluded from insurance coverage. The Verein assumes no liability in such cases.
(4) Regardless of the Verein's insurance coverage, all participants are recommended to hold their own private liability insurance (private Haftpflichtversicherung) covering damage to third parties during sporting activities.

§ 9 Limitation of Liability
(1) The Verein, its legal representatives, and the assigned Guides shall only be liable for property damage and financial loss in cases of intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit). Liability for slight negligence (leichte Fahrlässigkeit) is excluded for property damage and financial loss.
(2) This exclusion of liability does not apply to damages resulting from injury to life, body, or health caused by a negligent or intentional breach of duty by the Verein, its representatives, or Guides.
(3) In the event of breakdowns, accidents, or damage to bicycles or equipment, the Verein assumes no liability or costs for repair, recovery, or return transport.
(4) The Verein does not guarantee the continuous availability or error-free operation of the App. Temporary outages or technical disruptions do not give rise to any claims against the Verein.

§ 10 Account Deletion and Data Retention
(1) You may delete your account at any time via the App settings.
(2) Upon deletion, the following data will be immediately and irreversibly removed:
- Your profile data (first and last name, email address)
- Your profile picture (if applicable)
- Your ride statistics
- All friend connections
- All push subscriptions and delivery logs
(3) Your participation data (first and last name and ride date) will not be immediately deleted. This data is retained for insurance purposes for a period of 3 years from the date of the respective ride. It is restricted and may only be used for the purpose of verifying insurance coverage. After expiry of this period, it is automatically deleted.
(4) After account deletion, access to the App and to personal ride statistics is no longer available.

§ 11 Code of Conduct and Suspension
(1) Users commit to using the App only for its intended purpose. The following are expressly prohibited:
- Providing false identities (see § 4)
- Any form of harassment, discrimination, or disrespectful behaviour towards other users
- Attempts to manipulate or disrupt the technical infrastructure of the App or to gain unauthorised access to other users' data
- Use of the App for commercial or advertising purposes
(2) If third parties assert claims against the Verein based on a user's breach of these Terms of Use (in particular due to false name details or unlawful behaviour), the user in question shall indemnify the Verein against such claims, provided the user is responsible for the breach.
(3) The Verein reserves the right to temporarily suspend or permanently delete accounts in the event of a breach of these Terms of Use. Before permanent deletion, the user will, where possible, be informed and given the opportunity to respond.

§ 12 Intellectual Property
(1) All rights to the App, its design, software, and content belong to the Verein or the respective rights holders.
(2) The user is granted a simple, non-transferable right to use the App for the duration of their registration.

§ 13 Amendments to the Terms of Use
(1) The Verein may amend these Terms of Use with effect for the future, insofar as this is necessary for legal, technical, or organisational reasons.
(2) Users will be notified of material changes at least 4 weeks before they take effect, by email or in-app notification.
(3) If a user does not object to the amended terms within 4 weeks of receiving the notification, the amended terms shall be deemed accepted. The notification of changes will specifically draw attention to this right and the consequences of remaining silent.
(4) In the event of an objection, the Verein may terminate the usage relationship.

§ 14 Final Provisions
(1) The law of the Federal Republic of Germany shall apply.
(2) The contractual language is German (Vertragssprache). Where English translations of these Terms of Use are provided, they serve informational purposes only. In the event of any discrepancy, the German version shall prevail.
(3) Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected (Salvatorische Klausel / severability clause).
(4) The Verein is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body (Verbraucherschlichtungsstelle) (§ 36 VSBG).
